Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer may exercise their right of withdrawal.

  • Consumer: the natural person who does not act in the course of a profession or business and enters into a distance agreement with the entrepreneur.

  • Day: a calendar day.

  • Continuous transaction: a distance agreement relating to a series of products and/or services whose delivery and/or purchase obligation is spread over time.

  • Durable data carrier: any tool that enables the consumer or entrepreneur to store information in a way that makes future consultation and unchanged reproduction possible.

  • Right of withdrawal: the option for the consumer to withdraw from the distance agreement within the cooling-off period.

  • Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.

  • Distance agreement: an agreement concluded via a system organized by the entrepreneur for distance sales of products and/or services using one or more remote communication methods.

  • Remote communication technology: any means that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same place.

  • Terms and Conditions: these general terms and conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by Nordave™ and to every distance agreement concluded between Nordave™ and the consumer.

Before the distance agreement is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, Nordave™ will indicate how the Terms can be viewed electronically or sent free of charge upon request.

If the agreement is concluded electronically, the Terms and Conditions will also be provided electronically in such a way that they can be easily stored on a durable data carrier.

In the event of specific product or service conditions in addition to these Terms, the provisions most favorable to the consumer shall prevail in case of contradiction.

If any provision of these Terms is found to be invalid or void, the remaining provisions shall remain fully effective.


Article 4 – The Offer

All offers made by Nordave™ are non-binding unless explicitly stated otherwise.

Each offer contains a complete and accurate description of the products and/or services. Product images and descriptions are a truthful representation; however, colors and details may vary slightly due to screen display differences.

Obvious errors or mistakes in the offer do not bind Nordave™.

The offer clearly states:

  • Prices including applicable taxes

  • Possible shipping costs

  • The method of payment, delivery, and fulfillment

  • The existence or exclusion of the right of withdrawal

  • The validity period of the offer or price

  • Any communication costs if applicable

  • How the consumer can verify and correct their provided data

  • Whether the agreement will be archived and how it can be accessed

  • Available product variants (sizes, colors, materials)


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and complies with its terms.

When a consumer accepts an offer electronically, Nordave™ will promptly confirm receipt of the acceptance.

Nordave™ implements appropriate technical and organizational measures to secure electronic data transfers and ensure a safe online environment.

Nordave™ reserves the right to verify whether the consumer can meet payment obligations. If Nordave™ has justified reasons not to enter into the agreement, it may refuse an order or impose specific conditions.

Upon delivery, the following information will be provided:

  • Nordave™’s contact details for complaints

  • Conditions and procedure for exercising the right of withdrawal

  • Information about warranties and post-purchase services

  • The duration and termination terms for recurring agreements


Article 6 – Right of Withdrawal

Consumers have the right to cancel their purchase within 14 days after receiving the product, without giving any reason.

During this period, the consumer must handle the product and packaging carefully. Products should only be unpacked or used as necessary to assess the nature and features.

To exercise the right of withdrawal, the consumer must notify Nordave™ in writing (via email) within 14 days after receiving the item. The consumer then has another 14 days to return the item.

Returned products must include all accessories and, if reasonably possible, be in their original packaging.


Article 7 – Return Costs and Refunds

If the consumer exercises the right of withdrawal, return shipping costs are at the consumer’s expense.

Once the returned item is received or proof of shipment is provided, Nordave™ will refund the full purchase amount within 14 business days.


Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalized products

  • Sealed items that cannot be returned for health or hygiene reasons (if the seal has been broken)

  • Perishable goods or products with limited shelf life

  • Digital goods or downloadable content after access has been granted


Article 9 – Pricing

All prices listed on www.nordave.com include VAT.

Prices may change due to tax regulations or market fluctuations, but not within three months of purchase unless legally required.

Obvious pricing errors do not bind Nordave™.


Article 10 – Conformity and Warranty

Nordave™ guarantees that all products comply with the agreement, specifications, and reasonable expectations of quality and usability.

If a product shows a defect upon receipt, consumers must report this within 14 days after delivery.

The warranty does not apply if:

  • The product has been modified or repaired by the consumer or a third party

  • The product has been used improperly or not according to instructions

  • Damage is caused by external factors (e.g., moisture, negligence)


Article 11 – Delivery

Nordave™ takes the utmost care in processing and shipping orders.
Orders are delivered to the address provided by the consumer.

Accepted orders will be shipped within 30 days, unless agreed otherwise. If delivery is delayed, the consumer will be notified.

If delivery is impossible, Nordave™ will offer a suitable replacement or a full refund within 14 days.

The risk of damage or loss transfers to the consumer once the order is delivered.


Article 12 – Duration and Termination

For subscriptions or recurring deliveries:

  • Consumers may cancel at any time with a notice period of one month.

  • Agreements are not automatically renewed unless clearly stated and agreed upon.


Article 13 – Payment

Unless otherwise agreed, all payments must be completed within 7 business days after purchase.

Consumers must ensure that all payment details are entered correctly.

In case of non-payment, Nordave™ reserves the right to charge reasonable collection fees within legal limits.


Article 14 – Complaints

Complaints must be submitted to Nordave™ within 7 days after the issue is discovered, clearly describing the problem.

Nordave™ will respond within 14 days. If a complaint requires more time, Nordave™ will acknowledge receipt and provide a timeline for resolution.

Filing a complaint does not suspend payment obligations unless Nordave™ states otherwise in writing.


Article 15 – Disputes

All agreements between Nordave™ and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
